Article 3 Interpretation -2 

The expression "on or about" or similar will be interpreted as a stipulation that an event is to occur during a period of five calendar days before until five calendar days after the specified date, both start and end dates included.

The words "to", "until", "till", "from" and "between" when used to determine a

period of shipment include the date or dates mentioned, and the words "before" and "after" exclude the date mentioned.

 

The words "from" and "after" when used to determine a maturity date exclude the

date mentioned.

 

The terms "first half" and "second half" of a month shall be construed respectively

as the 1st to the 15th and the 16th to the last day of the month, all dates inclusive.

 

The terms "beginning", "middle" and "end" of a month shall be construed

respectively as the 1st to the 10th, the 11th to the 20th and the 21st to the last

day of the month, all dates inclusive.

(해석)

“on or about" 또는 유사한 표현은 어느 특정일이 첫째 날과 마지막 날을 포함하여 특정일의 전 5일부터 이후 5일까지의 기간 중에 발생해야 하는 규정으로 해석된다.

선적기간을 결정하기 위하여 “to", "until", "till", "from" 그리고 ”between" 의 용어들은 명시된 일자를 포함하고, “before", "after"의 용어들은 명시된 일자를 제외한다.

만기를 결정하기 위하여 “from", ”after"의 용어들은 명시된 일자를 제외한다.

어느 달의 “first half", 및 ”second half"라는 용어는 각각 그 달의 1일부터 15일까지, 16일부터 말일까지로 해석되며, 그 기간 중의 모든 날짜를 포함한다.

어느 달의 “beginning", "middle" 및 ”end"라는 용어는 가각 그 달의 1일부터 10일, 11일부터 20일, 21일부터 말일로 해석되며, 그 기간 중의 모든 날짜가 포함된다.

해당 조항에 대한 설명

5. "on or about" ±5(당일포함)

SWIFT 44D : on or about MAY 6

44D는 선적날짜를 의미하며, 1일~11일까지 총 11일을 의미한다.

 

 

 

6. "before", "after", "from"

선적기간을 산정 시, “before", "after"은 해당 일을 제외한다.

ex) before 20 day, 즉, 19일까지를 의미한다.

 

어음기간을 산정 시, “from","after"은 해당 일을 제외한다.

ex) from 20 day, 즉, 21일부터를 의미한다.

 

 

7. "first half" , "second half"

ex) SWIFT 44D : first half

그 달의 15일까지 선적을 완료해야함을 의미한다.

8. 환어음의 어음기간 산정

만약 신용장이 “30 days after the bill of lading date"의 환어음을 요청하고, bill of lading의 발행날짜는 2009년 12월 19일이였다. 환어음의 어음기간을 표시방법은 다음과 같다.

 

a) “30 days after the bill of lading date 19 DEC 2009"

b) “30 days after 19 DEC 2009"

c) “30 days after the bill of lading date" 기입 후, 반드시 환어음의 어느 곳에 “the bill of lading date 19 DEC 2009"이라고 기입하였다.

d) “30 days date" 선화증권의 발행날짜와 환어음의 발행날짜가 동일할 경우

e) “19 JAN 2009" 어음의 만기기간을 산정하여 기입

 

ex) 환어음의 어음기간에 “60 days after the bill of lading date" 라고 기입하였다. 하자가 아닌가?

→하자이다. 단순히 “30 days after the bill of lading date"라고 기입하면, bill of lading date를 알 수 없기에 반드시 환어음의 문면상에 기입하여야 한다.
